Copyright Policy
1. Copyright Compliance
The Company respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.
Because the Services operate under an encrypted architecture, and the Company does not possess a mechanism to decrypt User-stored Holograph content, the Company does not review or monitor User-stored Holograph content.
2. Designated DMCA Agent
DMCA notices should be directed to the Company's designated agent:
The Company has registered its DMCA agent with the U.S. Copyright Office.
3. DMCA Notice Requirements
A valid DMCA notice must include:
- The signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material and sufficient information to locate it
- Contact information of the complaining party
- A good faith statement that the use of the material is not authorized by the copyright owner, its agent, or the law
- A statement under penalty of perjury that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner
Incomplete notices may not be processed.
4. Company Response to Notices
Upon receipt of a valid notice, the Company will act expeditiously as required by law. Due to encryption, the Company cannot view or evaluate encrypted content and cannot selectively edit encrypted files. Responsive action may include disabling account access, revoking shared permissions, and/or terminating Users related to the notice, among others.
5. Counter-Notification
Users who believe their content was removed or disabled as a result of mistake or misidentification may submit a counter-notice containing the required statutory elements. If a counter-notice is valid, the Company may restore access unless the original complainant seeks court intervention within the period prescribed by the DMCA.
6. Repeat Infringer Policy
The Company maintains a policy of terminating, in appropriate circumstances, Users who are repeat infringers. Determinations are based on properly submitted and substantiated notices.
7. No Duty to Monitor
Nothing in these Terms imposes a duty on the Company to monitor User content. The encrypted architecture prevents proactive review of Holograph materials.
